Privacy Policy

1. Introduction

1.1 European Boating Association (EBA, we and us) is committed to protecting and respecting your privacy. The EBA is a “controller” of the personal information that we collect from you or you provide to us.

1.2 This policy sets out the basis on which any personal information we collect from you, or that you provide to us, either through our website (the Site) or at any other time will be used.

2. What information do we collect?

2.1 Membership

2.1.1 When an organisation applies to join or becomes a member of the EBA, we will collect the title, name, address and contact details of the representatives of that organisation. Contact details may include business or personal phone numbers, email addresses and addresses for correspondence.

2.1.2 During the time an organisation is a member of the EBA we may collect further information concerning its representatives, including the title, name and contact details of those attending EBA meetings and functions, or those mentioned in correspondence. Photographs may be taken of delegates at EBA meetings and functions, and may be published in the Members’ Area of the EBA website and used in presentations.

2.2 Website

2.2.1 We will collect any details you provide us when contacting us through the Site.

2.2.2 Access to the members’ only areas of the EBA website is restricted to those who are nominated as a representative by a full member of the EBA or who are granted access by the EBA Secretariat. When you are registered to use the site, any details you provide will be retained by us for use on future visits to the site.

2.3 General Information

2.3.1 When we are provided with your details in order to contact you in connection with EBA business we will retain this information.

3. Why do we need this information?

3.1 Purpose of the EBA

3.1.1 The EBA was established for not-for-profit making purposes and does not make a profit.

3.1.2 The EBA will only:

  • process information necessary to establish or maintain membership or support;
  • process information necessary to provide or administer activities for people who are members of the organisation or have regular contact with it; 
  • hold information about individuals whose data we need to process for this exempt purpose.

The personal data we process is restricted to personal information that is necessary for this exempt purpose.

3.2 Membership

3.2.1 We need to collect personal information relating to our members’ representatives so that we can manage membership and the business of the EBA. We will use this information to contact members and to provide member services. The legal basis for this shall be contract. We will use the personal information in relation to our member representatives to create a log-in to the EBA members’ area. Representatives may log in to the EBA members’ area to update their personal information or to use EBA forums or to use the EBA members’ messaging system. We may also use this information in pursuit of our legitimate interests. Our legitimate interests could include: sharing information with you which we believe is of interest to EBA members, but which may not be essential to the business of the EBA, and for creating marketing material to promote the EBA. Where we process your information in pursuit of our legitimate interests, you have the right to object to us using your information for that purpose.

3.3 Website

3.3.2 We use the information collected about you via our website in the following ways:

  • to respond to your comments and queries;
  • to ensure that content from the Site is presented in the most effective manner for you and for your computer;
  • to allow you to participate in any interactive features of our services, when you choose to do so; and
  • to notify you about changes to our Site.

4. Cookies

4.1 The Site uses some unobtrusive cookies to store information on your computer.

4.2 A cookie is a small piece of information that is placed on your computer, and is used to differentiate you from other users accessing our Site.

4.3 Some cookies on the Site are essential, and the Site won’t work as expected without them. These cookies are set when you submit a form, login or interact with the Site by doing something that goes beyond clicking on simple links.

4.4 We also use some non-essential cookies to anonymously track visitors or enhance your experience of the Site. If you’re not happy with this, we won’t set these cookies but some nice features of the site may be unavailable.

5. Who we share your personal information with

5.1 We will never sell your personal data. We will not share your personal data with any third parties without your prior consent (which you are free to withhold) except where we are required to do so by law or as set out below.

5.2 We will share your data with The Royal Yachting Association (RYA) who are the secretariat to the EBA.

5.3 The RYA engages WordPress and Mangopear Limited (trading as Mangopear creative) as a sub processor in respect of the EBA website. In addition you may input your information into Cognito Forms or Formidable Forms when using EBA services.

5.4 We will share certain information relating to our member’s representatives with other members of the EBA.

5.5 We may pass your personal data to third parties who are service providers, agents and subcontractors to us for the purposes of completing tasks and providing services to you on our behalf (e.g. in connection with a conference booking). We do this for the purpose of our legitimate interests in operating the EBA and for performing our contract with you. However, we disclose only the personal data that is necessary for the third party to deliver the service and we have a contract in place that requires them to keep your information secure and not to use it for their own purposes. It is possible that third parties may themselves engage others (subprocessors) to process your data. Where this is the case third parties will be required to have contractual arrangements with their sub-processor(s) that ensure your information is kept secure and not used for their own purposes.

6. How long we keep your personal information

6.1 We will only keep your personal information for as long as necessary for us to provide membership services, and for as long afterwards as it is in our legitimate interests to do so or for as long as necessary for us to do so to comply with our legal obligations. This generally means we will retain personal data for up to three years after you have ceased to be a representative of a member organization, or three years after the organisation you represent has ceased to be a member of the EBA . Photographs and publicity material may be retained for archive purposes.

7. Internet Security

7.1 EBA takes the security of any personal information we hold very seriously. Your personal information is stored on servers in the United Kingdom, managed by the RYA in accordance with its role as the secretariat for the EBA.

7.2 In addition to what the EBA does to safeguard your privacy and security, there are a number of things you can do to protect yourself from Internet fraud, like choose a password you can remember but others will not guess, change it regularly, and if you do write it down, keep it somewhere safe and secure.

7.3 Where we have given you (or where you have chosen) a password which enables you to access certain features or parts of the Site, you are responsible for keeping this password confidential. You must not share the password with anyone.

7.4 When you have finished your session on the Site, make sure that you prevent your details being seen by anyone that you do not wish to see them. So, if you have registered and logged in, remember to log off. We also recommend you then close your browser so any history of the session is cleared.

8. Third Party Websites

8.1 Third party internet sites that you can link to through websites are not covered by this policy, so we urge you to be careful when you enter any personal information online. The EBA accepts no responsibility or liability for these websites.

9. Your Rights

9.1 You can exercise any of the following rights by emailing eba@rya.org.uk. Your rights in relation to your personal information are:

  • to access your personal data
  • to be provided with information about how your personal data is processed
  • to have your personal data corrected
  • to have your personal data erased in certain circumstances
  • to object to or restrict how your personal data is processed
  • to have your personal data transferred to yourself or to another business in certain circumstances.

10. General

10.1 The European Boating Association (Europaischer Sportschiffahrtsverband, Association Européenne de Navigation de Plaisance) (EBA) is a civil, not for profit association of recreational boat users’ organisations, founded in 1982 and established as an Unincorporated Association. The Secretariat for the European Boating Association is provided by the Royal Yachting Association (RYA). The RYA’s registered office address is RYA House, Ensign Way, Hamble, Southampton SO31 4YA, UK.
